1. General Information on Internet Service
Internet Service is an Internet-based public marketplace for users to find or post their jobs. It is also possible for private people to place ads. Internet Service brings together empleyees and employers a common marketplace.
The purpose of the Internet Service is to publish advertisements for employee and emplyer. DispatchRay is in no way involved in the transaction or the purchase contract. All details of the Object are provided by the advertiser. DispatchRay is not responsible for the information presented in the advertisement in the Internet Service.
The purpose of the advertisements published in the Internet Service is solely to inform. Although DispatchRay wishes that internet user who use the Internet Service are careful and act in good faith, DispatchRay cannot guarantee that the data supplied by advertiser is free from errors. Before contact advertiser on the Internet Service, the user is obliged to check with the advertiser all the details that may affect the users decision. If you decide to get a job or any other product on the basis of data published in the Internet Service, your contracting partner is the advertiser of the product and not DispatchRay.
2. Data Protection and Use of Cookies
DispatchRay respects users not privacy and strives with commercially reasonable means to prevent inappropriate use of the personal data provided to the Internet Service. Data collected or provided to DispatchRay is stored on servers in the USA. DispatchRay may use and transfer customer information (such as name and e-mail addresses) to third party service providers to perform functions in connection with DispatchRay’s services. When DispatchRay uses third party service providers who help DispatchRay support its business operations, DispatchRay uses contractual and technological means to require those service providers only to use the information provided to them to deliver DispatchRay’s products and services – not for their own use. Data can also be transferred to suppliers of accessories, supplementary products and financing services, or to other suppliers of used machinery and services, in accordance with a user’s request for those services. Further information can be found in our Privacy Policy which includes information about the use of cookies by DispatchRay. By registering as a user of the Internet Service you agree to this Privacy Policy, including DispatchRay’ use of cookies.
3. To Publish an Advertisement
An ad that you post or send to DispatchRay is interpreted as a request to have the advertisement published on the Internet Service. It is the advertiser not responsibility to specify in which category of the advertisement must be published; on DispatchRay website listings, on DispatchRay car hauler for sale or rent, DispatchRay car hauler job, DispatchRay main site (seller nots own used machines listing on its own website) and/or the seller nots own intranet/extranet service. The user of the Internet Service is responsible for making sure that it has acquired necessary rights and permissions to the content produced by it to the Internet Service. The content produced by it should not infringe any intellectual property rights or other rights of any other person or entity and should not contain statements or material the publication of which may give rise to liability to damages or liability for DispatchRay. The user of the Internet Service shall fully compensate any and all damage to DispatchRay if the content does not comply with this provision.
If an advertisement for some reason is not suitable for publication, DispatchRay will contact the advertiser via email. DispatchRay reserves the right to remove the content immediately without further notice to the advertiser and to terminate the usage rights of a advertiser or user that, according to DispatchRay assessment, is using the Internet Service improperly or in a way contrary to good manners. The preconditions for publication of each advertisement are assessed separately.
DispatchRay has the right to edit, classify, and copy all or part of the material you have entered into the Internet Service and use it freely in its business.
DispatchRay is not able to check whether the information supplied by the users is correct. Therefore, the informant is fully liable for any costs and damages incurred due to incorrect information given to DispatchRay. It is possible to suspend the publication of an advertisement at any time. Advertisement fee will not be charged if the advertisement is cancelled before it is published.
Due to DispatchRay intervals to index data and safety measures, the contents of paid advertisements are not immediately visible on DispatchRay Internet Service. Indexing intervals can vary depending on server load. Ads from DispatchRay invoice customers are usually visible on the Internet within hours. To ensure the safety of our customers and visitors, private advertisements are checked for fraudulent, deceptive or unlawful content. This check can take up to 72 hours until the advertisements are visible on the DispatchRay Internet Service.
DispatchRay is required to return the advertisement fee if DispatchRay fails to publish an approved advertisement. The compensation for an unpublished advertisement is limited in all cases to the paid advertisement fee. Advertisement fee does not need to be returned if the advertisement has not been published because of factors beyond DispatchRay control or for reasons which DispatchRay could not reasonably foresee or prevent.
4. Charges and Billing
It not free to register as a user of the Internet Service, to read the ads, contact advertiser and to publish inquiries.
The publication of individual ads on Internet Service is a chargeable service. The fees charged for the published advertisements are set according to the current price list. Publication of an advertisement that is sent to the Internet Service is always conditional upon that the fee is paid for the advertisement. Advertisements are paid either by using PayPal, online banking, bank transfer or by credit card. On the DispatchRay home page there are links to the online banking to be used for payment. No advertisement will be published before it is fully paid.
5. Intellectual Property Rights
The user acknowledges that all intellectual property rights with respect to the web sites, the domains, the sub domains, the design, the text, the content, the images, the logo, the trademark DispatchRay, the software and program material and other material contained in the Internet Service belongs to DispatchRay, with the exception of the content of the ads, and the user hereby explicitly waives any rights in respect of such intellectual property. Unless DispatchRay has explicitly given written permission, the users may not distribute, publish, reproduce, make available to the public or commercially or otherwise exploit the protected material.
6. Compensation for Damages and Limitation of Liability
DispatchRay does not warrant that the Internet Service will operate error-free or that the Internet Service and its servers are free from computer viruses or other harmful mechanisms. DispatchRay cannot be held liable for any damage resulting from errors, computer viruses or other harmful mechanisms. If the use of the Internet Service results in the need for servicing or replacing equipment or data, DispatchRay is not responsible for these costs. Internet Service is delivered "as is" and DispatchRay is not responsible for any damages caused by the use of the Internet Service or the malfunction or failure of the Internet Service.
If there is an error caused by DispatchRay in the case of fee-based services, DispatchRay can choose either to correct the error or return the advertisement fee to the user. The amount of compensation is at most equal to the amount of the ad fee that the user has paid for DispatchRay for use of the Internet Service. DispatchRay is not responsible for damage caused by user or third party or damage that DispatchRay could not reasonably have foreseen.
7. Availability
DispatchRay has the right, without notice, in whole or in part, remodel, remove, add or otherwise change the contents of the Internet Service, or its operating times, technical details or other content. DispatchRay has the right to temporarily suspend delivery of the Internet Service for maintenance or modification of the Internet Service and DispatchRay cannot be held liable for such suspension, maintenance or modification.
8. Amendment of Conditions
The selection and design of the Internet Service might change or get upgraded. DispatchRay reserves the right to change the conditions of its services. The user shall be informed of the amended terms and conditions via e-mail. The amendments will become effective after log-in. If you continue to use the Internet Service after the terms have been changed, you acknowledge that the new terms are binding on you even if you have registered as user prior to the new terms came into force.
9. Feedback
If you believe that material in the Internet Service to any part is incorrect or faulty, please notify us by sending information to DispatchRay from the "feedback" link on the Internet Service´s home page. Please describe the error or defect in detail in the message and include your contact name, email and phone.
10. Nullity of Terms
If any term of these general terms is considered to be invalid, void or unenforceable to any extent, all remaining terms shall remain in full force and effect.
11. Force Majeure
A party is not liable for breach of contractual obligations due to obstacles that are beyond the party´s influence (e.g. strike, lockout, data communication disorder, fire, theft, water damage, sabotage, vandalism or any other such unexpected event), obstacles a party reasonably could not predict when concluding the agreement and the consequences which the party could not reasonably have prevented.
12. Validity of Terms
These binding conditions will take effect when you accept them by using the Internet Service or by registering as a user on the Internet Service. The conditions are valid for an indefinite period. DispatchRay can always deny the user the right to use the Internet Service if the user violates these conditions, interferes with other users or usage of the service.
13. Early Termination
Notwithstanding what is otherwise prescribed, either party may by notice cancel the agreement with immediate effect if:
a) Either party fundamentally breaches its responsibilities under this agreement and fails to remedy within 30 days after written request.
b) Either party suspends payments, offers instalment, goes bankrupt, becomes subject to seizure or other similar circumstance occurs that could reasonably be regarded as evidence of insolvency or liquidation.
14. Subcontractors
DispatchRay has the right to use subcontractors in the provision of its services.
15. Settlement of Disputes and Applicable Law
Dutch law shall apply to this agreement, excluding its choice of law provisions. Any dispute, controversy or claim arising out of or relating to this agreement, or the breach, termination or validity thereof, shall be finally settled by the Court of Chicago, IL USA
In every business and industry there are criminals and individuals that will attempt to take advantage of unsuspecting innocent people to steal and commit fraud. DispatchRay is doing everything it can to prevent these criminal elements from preying on our users and customers. Please read this document to learn precautions that you can take to protect yourself when searching jobs online. It provides examples of the common tricks, techniques and methods that criminals preying on our industry use to steal and commit fraud. DispatchRay connects advertisers and users but we are not involved in any transactions or contracts between the advertiser and user. DispatchRay does not get notified who needs a job and from whom. All conditions and the agreement concluding a purchase deal are made only between the advertiser and the user. DispatchRay has no information or resources to check or even guarantee the credit worthiness or authenticity of a advertiser. If ever you should receive any information or documents that DispatchRay guarantees the credit worthiness or authenticity of a particular advertiser, then this information is forged. In that case, please contact us immediately.
Quick Tip.
Passwords & Usernames
Never' give out your usernames, passwords, or PINs to anyone. Dispatch Ray will never ask for any of these.
A strong password is at least nine characters long, has a combination of letters, numbers and symbols, and with some uppercase characters, too.
Change passwords routinely. Or use password management apps if you’re worried you won’t remember the password.
Email Attachments
Be' cautious about opening email attachments. Always make sure you scan them with anti-virus software first. Do not click on links within unsolicited email.
Ignore emails that claim to be from a retailer (or your bank or Internet Service Provider). These “phishing” attempts look legit, but it they ask you to confirm your financial or personal details on a website, they’re fake.
Contact the sender to make sure the email is legitimate, and scan it carefully. Avoid having email programs set to preview email, as this can open a virus email before you have a chance to scan it.
Do not click links inside an email if it seem suspicious, even if it is sent from someone you know. Viruses are often hidden in seemingly harmless programs that people share for fun. Because many viruses make use of peoples’ address books, you may receive virus emails from people you know.
Payment methods
Never send credit card numbers via email.
Always use a secure Internet connection when making a purchase. Reputable websites use technologies such as SSL (Secure Socket Layer) that encrypt data during transmission.
Look for the little padlock in the address bar or a URL that starts with “https” instead of “http,” as the “s” stands for “secure.” Some browsers will tell you it’s safe to give out your credit card by showing you a green address bar, while unprotected ones will be highlighted in red
Only shop with seller’s that take secure payment methods, such as credit cards, PayPal or Venmo as they likely give you buyer protection just in case there’s a dispute. Beware of sellers that only accept money orders, wire transfers, or checks.
If purchasing outside your local area, consider using a legitimate escrow service . Go to the escrow service’s website directly. Do not go to the website through a link in an email or use a service recommended by the seller.
Even with cash transfers, you can become a victim of fraud, please see the examples below: Sellers request a small advance payment to secure your “right to buy” the machine. Equipment is priced well below the expected market price. Seller requests transfer of the down payment into a “trusted” person’s account. Seller requests confirmation of funds transfer by requesting precise amount of sum, and the name of the account holder on the originating account. The "seller" then withdraws the money with a fake ID and papers. This type of fraud is possible for cash transfer payments (ie. Money Gram, Western Union, Escrow) and for bank transfers. The information and the documents about that machine or vehicle and the ID of the fraudulent seller are false.
Meeting the seller and verify the vehicle, trailer, equipment you are buying.
If you are meeting a seller/dealer that you don not know, use caution: Meet in well populated areas. Avoid remote areas that seem dangerous to you, arrange a different more secure location if necessary. Avoid carrying cash or checks (of the agreed selling price) with you to the place where you are going to meet the seller. If the seller is not the same person as stated in the vehicle registration ownership certificates, request a certificate of authority from the owner to avoid purchasing stolen equipment. Always verify that the equipment ID has matches the ID stated in the contract. Most machine serial numbers are marked on plates or stamped on chassis components. Ensure this numbers match with each other and with the serial number on the documents. Check with the machine manufacturer if you have any concerns. Digital speedometers can be altered to increase the price of the vehicle. If you doubt the readout amount shown on the meter, bring the vehicle to an independent inspector, to check if the meter was tempered with. As a seller, you should have the necessary documents about the vehicle or machinery as proof for your customer, however never take these documents (especially vehicle registration certificates) with you on a test drive with the "buyer". Keep them in a secure location. Always make sure that all expensive extra equipment (such as Radio, CD-Player, speakers or rims, buckets) are listed in the purchase contract. This especially important if there is a significant delay in delivery. Always carefully read small printed text in the purchase contract. Avoid pricing language in the contract that relies on an external inspection estimating the value amount.
Other types of frauds.
Delivery Transfer document certificate. The "seller" might contact the buyer after a verbally agreed upon deal to confirm that he shipped the item. He confirms it with a faxed, scanned, emailed or posted shipment order confirmation / warranty was by Transport Company (like i.e. DHL). He asks the buyer to transfer the whole sum or a part of the sum. The item never arrives, because the machine, its documents as well as the shipping warranty does not really exist. They are forged. Always inspect the machine yourself if possible to verify that it exists. The buyer should arrange the shipment with a Transportation company that they trust and purchase a transportation warranty with that transport company. Check that the item you ordered is the item that is shipped and be present if possible when the shipment takes place.
Telephone-fraud.
A potential "buyer" is enquiring about your ad and requests that you call him/her back on a nopremium rate no phone number. You will be put on hold and therefore without knowing pay them for nothing. Never call back any phone numbers that use premium rate dial codes.
Export list fraud. A potential "buyer" doesn not want to buy your vehicle, but wants to put that machine into a circulated export list publication. Criminal never provides additional informational materials, but sends a bill stating that you consented to enter your machine in that publication. Often sellers with finance departments will pay these invoices without proper verification.
Note about fraud
There are a large number of tricks, methods and techniques that criminals try to use to defraud innocent buyers and sellers. Every day new methods and frauds are devised. Unfortunately DispatchRay cannot cover all of them, but we will continue to update this document when we see new fraud methods emerge in our industry. This security advice is available to warn the users of DispatchRay about precautions of buying and selling used equipment. You should always use common sense and to be mindful of possible fraudulent activities in the deals that you make via the buyers and sellers found on the DispatchRay marketplace.
Beware of Text Message Fraud
Be cautious of Over Payment fraud attempts that begin with a text message. This fraud will involve a large amount over the price for the item you are selling with instructions to wire the additional funds (the amount over your selling price) to the buyer’s pickup agent or inspector. The current trend involves the buyer using a fake PayPal invoice to lure the seller into a false sense of security. If you receive a text message and/or email using this scenario, please forward the telephone number the text was received from and any pertinent information to info@dispatchray.com
Anti-Virus Software/Anti-Spyware and Firewalls. Protect your computer by using the most updated versions of anti-virus software to scan your system and e-mail for malicious viruses. Use anti-spyware or adware programs to remove programs that track your Internet activity. Use a firewall to make your computer invisible to outside attackers. Even if your network is secure, you should still use a firewall. This an electronic barrier that blocks unauthorized access to your computers and devices, and is often included with comprehensive security software. Using a firewall ensures that all of the devices connected to your network are secured, including Internet of Things (IoT) devices like smart thermostats and webcams. This is important since many IoT devices aren’t equipped with security measures, giving hackers a vulnerable point of entry to your entire network. A firewall is especially critical if you have your computer on a cable or DSL Internet connection that is constantly connected to the Internet. Security Updates for Operating Systems/Browsers Update your browser regularly. Each new version of your Internet browser, especially if you use one of the more popular browsers, gets a boost in security. Avoid older browsers. Besides not working as well with some websites, they often have holes in their security that hackers have discovered and can exploit. The same goes for your operating system and anti-virus software. Keep everything as up-to-date as possible. Updates will keep you ahead of would-be identity thieves and keep your credit safe.

File a report. File a report at www.ic3.gov with the Internet Crime Complaint Center, a partnership between the Federal Bureau of Investigation (FBI), the National White Collar Crime Center (NW3C), and the Bureau of Justice Administration (BJA).
